He said, “An approach that attempts to mechanically separate the ‘industrial’ element of a government activity from its broader sovereign or welfare purpose risks producing results that may be both theoretically unsound and practically impractical.”Additional Solicitor General KM Nataraj and senior advocate Shekhar Naphade, appearing for UP and Maharashtra respectively, said if the activity undertaken by the government is not rooted in commerce or does not involve ‘profit making’, then it should not be classified as industry.
