मामले की सुनवाई के दौरान जस्टिस मदन पाल सिंह ने कहा कि भरण-पोषण का अधिकार एक वैधानिक अधिकार है और यह केवल उन्हीं लोगों को प्राप्त है जिनका कानून में स्पष्ट उल्लेख है. उन्होंने कहा कि सास-ससुर इस श्रेणी में नहीं आते, इसलिए बहू को उनका भरण-पोषण करने के लिए बाध्य नहीं किया जा सकता। कोर्ट ने यह भी कहा कि सिर्फ नैतिक जिम्मेदारी के आधार पर किसी को कानूनी तौर पर बाध्य नहीं किया जा सकता.

याचिका खारिज करते हुए कोर्ट की टिप्पणी
कोर्ट ने बुजुर्ग दंपत्ति की ओर से दायर पुनरीक्षण याचिका को खारिज कर दिया. याचिका में आगरा के फैमिली कोर्ट के अगस्त 2025 के फैसले को चुनौती दी गई थी, जिसमें भरण-पोषण के लिए उनकी अर्जी खारिज कर दी गई थी. कोर्ट ने कहा कि विधायिका ने जानबूझकर सास-ससुर को इस कानून के दायरे में शामिल नहीं किया है, इसलिए यह जिम्मेदारी बहू पर नहीं डाली जा सकती.

बुजुर्ग दंपत्ति ने क्या दिए तर्क?
दंपति ने अपनी याचिका में कहा था कि वे बुजुर्ग, अशिक्षित और आर्थिक रूप से कमजोर हैं और अपने बेटे पर निर्भर हैं. उन्होंने यह भी बताया कि उनकी बहू उत्तर प्रदेश पुलिस में कांस्टेबल है और उसकी पर्याप्त आय है. दंपति ने कहा कि उनका भरण-पोषण करना बहू का नैतिक कर्तव्य है और इसे कानूनी दायित्व माना जाना चाहिए।

कोर्ट ने दलीलें खारिज कर दीं
कोर्ट ने इन दलीलों को खारिज करते हुए कहा कि रिकॉर्ड पर इस बात का कोई सबूत नहीं है कि बहू को अनुकंपा के आधार पर नौकरी मिली है. अदालत ने यह भी स्पष्ट किया कि मृत बेटे की संपत्ति से संबंधित विरासत के मुद्दों को इस प्रकार के भरण-पोषण मामलों में शामिल नहीं किया जा सकता है। इस फैसले से यह साफ हो गया है कि ऐसे मामलों में कानून के दायरे में आने वाले अधिकार ही मान्य होंगे.
