इलाहाबाद उच्च न्यायालय: लिव-इन रिलेशनशिप को लेकर इलाहाबाद हाई कोर्ट ने एक अहम फैसला सुनाया है. कोर्ट ने साफ कहा है कि अगर कोई शादीशुदा पुरुष आपसी सहमति से किसी वयस्क महिला के साथ लिव-इन रिलेशनशिप में रह रहा है तो यह कोई अपराध नहीं है। अदालत ने यह भी कहा कि सामाजिक नैतिकता नागरिकों के अधिकारों की रक्षा के अदालत के कर्तव्य से ऊपर नहीं हो सकती। यह सुनवाई जस्टिस जेजे मुनीर और जस्टिस तरूण सक्सैना की खंडपीठ में हुई.
परिवार से मिल रही धमकियों के बीच दंपति ने सुरक्षा की मांग की है
मामले में याचिका दायर करने वाले जोड़े ने कोर्ट से सुरक्षा की मांग की थी. उन्होंने कहा कि महिला के परिवार से उन्हें लगातार धमकियां मिल रही हैं. परिवार ने दलील दी कि शादीशुदा पुरुष का दूसरी महिला के साथ रहना अपराध है, लेकिन कोर्ट ने इस दलील को खारिज कर दिया.
कानून और नैतिकता को अलग रखने की बात
कोर्ट ने अपने फैसले में साफ कहा कि कानून और सामाजिक नैतिकता को अलग-अलग देखा जाना चाहिए. यदि कोई कार्य कानून के तहत अपराध नहीं है तो केवल नैतिकता के आधार पर उसे अपराध नहीं माना जा सकता। कोर्ट ने कहा कि सहमति से साथ रहने वाले वयस्कों के खिलाफ कोई आपराधिक कार्रवाई नहीं की जा सकती.
पुलिस को सुरक्षा मुहैया कराने के निर्देश दिए
कोर्ट ने यह भी कहा कि महिला पहले ही शाहजहांपुर के एसएसपी को आवेदन दे चुकी है, जिसमें उसने कहा है कि वह बालिग है और अपनी इच्छा के मुताबिक लिव-इन रिलेशनशिप में रहना चाहती है. इसके बावजूद पुलिस ने कोई कार्रवाई नहीं की. कोर्ट ने साफ किया कि ऐसे मामलों में जोड़े की सुरक्षा करना पुलिस की जिम्मेदारी है.
सुप्रीम कोर्ट के आदेश का हवाला देते हुए ऑनर किलिंग का खतरा
कोर्ट ने कहा कि दंपत्ति को ऑनर किलिंग का खतरा है, इसलिए सुरक्षा जरूरी है. इस दौरान शक्ति वाहिनी बनाम भारत संघ का हवाला दिया गया, जिसमें कहा गया कि ऐसे मामलों में सुरक्षा सुनिश्चित की जानी चाहिए.
राज्य सरकार को नोटिस, गिरफ्तारी पर रोक
हाई कोर्ट ने राज्य सरकार को नोटिस जारी कर 8 अप्रैल तक जवाब देने को कहा है. साथ ही याचिकाकर्ता अनामिका और नेत्रपाल की गिरफ्तारी पर रोक लगा दी है. उनके खिलाफ शाहजहाँपुर के जैतीपुर थाने में मामला दर्ज किया गया था। अदालत ने महिला के परिवार को भी निर्देश दिया कि वे जोड़े को किसी भी तरह से नुकसान न पहुंचाएं और उनसे संपर्क न करें।
अधिकारियों की जिम्मेदारियां तय
कोर्ट ने साफ कहा कि जोड़े की सुरक्षा के लिए एसएसपी शाहजहांपुर व्यक्तिगत तौर पर जिम्मेदार होंगे. इस मामले में याचिकाकर्ताओं की ओर से अधिवक्ता शहंशाह अख्तर खान उपस्थित हुए, जबकि राज्य की ओर से अपर सरकारी अधिवक्ता घनश्याम कुमार और निजी पक्ष की ओर से अधिवक्ता अजय कुमार मिश्रा ने दलीलें पेश कीं.

A 10-year-old girl in Maharashtra’s Sangli district died after she was allegedly hanged upside down in their home by her father and kept in that position overnight, police said on Friday. The man had allegedly tortured the girl on suspicion that she had stolen money from a relative.The accused farmer Dadu alias Nana Yamgar has been arrested. Police said he also subjected the girl’s 11-year-old sister to similar torture. The elder sister is currently undergoing treatment in the hospital.The incident came to light on Thursday when doctors informed the police in Atpadi taluka about the death of the girl named Rutuja.Police said other family members, including Yamgar’s father, tried to intervene and save the girls, but he allegedly threatened them with the sickle. The result was that both the girls remained hanging upside down throughout the night. Police said that even Rutuja’s repeated requests for water had no effect on her.“Yamgar hanged his two daughters – Rutuja and Anuja – upside down by tying their hands and legs to an iron angle fixed to a wall under the roof of their house. He was angry as he suspected that the two girls had stolen money from a relative’s house at Banpuri in Atapadi,” a police officer was quoted as saying by PTI.Police said both the girls were found unconscious in the morning and were brought down by family members. After this the sisters were taken to the government hospital, but Rutuja’s condition deteriorated.Police said he died on the way to a hospital in Pandharpur in Solapur district. His elder sister Anuja is currently undergoing treatment in a hospital.The matter came to light when hospital authorities informed the police, following which the girls’ father was taken into custody. Police said the accused is suspected to be mentally unstable.A case has been registered against Yamgar under relevant sections of the Indian Justice Code (BNS) and further investigation is underway.

However, the party has not officially announced its programme. “Yes, the CM will start campaigning from Friday and hold several rallies, but the party will officially notify the schedule soon,” a source said.The party’s focus is on seats in the Upper Assam region, home to tea gardens where a large number of tribals live and work. Before the formal announcement of the elections, Hemant had addressed two rallies in Assam, indicating JMM’s intention to contest seats in that state. After the failure of seat sharing talks with its ally Congress, JMM changed its stand and went ahead and announced candidates for 21 seats.“It is unfortunate, but due to delay in seat-sharing talks, all JMM nominations were filed on the last day. As a result, three candidates made some mistakes in their nomination forms due to which their nominations were rejected during scrutiny,” a source said.
