देहरादून एयरपोर्ट पर खान-पान के संचालन को लेकर चल रहे मामले में उत्तराखंड हाईकोर्ट ने अहम फैसला देते हुए मनीष टैक्सी सर्विस की ओर से दायर दोनों याचिकाओं को खारिज कर दिया है. यह फैसला मुख्य न्यायाधीश मनोज कुमार गुप्ता और न्यायमूर्ति सुभाष उपाध्याय की खंडपीठ ने दिया है.

भारतीय विमानपत्तन प्राधिकरण (एएआई) ने वर्ष 2024 में खाद्य और पेय पदार्थों की दुकानों के संचालन के लिए एक रियायत समझौता किया था, जिसके तहत याचिकाकर्ता की फर्म को सात साल तक संचालन का अधिकार दिया गया था। लेकिन बाद में लाइसेंस शुल्क के भुगतान और अन्य शर्तों के अनुपालन को लेकर दोनों पक्षों के बीच विवाद पैदा हो गया.

टेंडर प्रक्रिया भी रोकने की मांग की गयी

एएआई का आरोप था कि याचिकाकर्ता समय पर बकाया राशि जमा नहीं कर सका. जिसके संबंध में कई नोटिस जारी किए गए थे. एएआई द्वारा बकाया भुगतान न करने पर बैंक गारंटी से संबंधित राशि की वसूली के बाद 31 मई 2025 को रियायत समझौता समाप्त कर दिया गया था। याचिकाकर्ता ने एएआई की इस कार्रवाई को अनुचित बताते हुए हाई कोर्ट में चुनौती दी थी और एएआई द्वारा जारी टेंडर प्रक्रिया को रोकने की मांग की थी.

उनका कहना था कि पूरी साइट उन्हें समय पर नहीं सौंपी गई, जिससे कारोबार प्रभावित हुआ। सुनवाई के दौरान हाई कोर्ट ने पाया कि दोनों पक्षों के बीच विवाद पूरी तरह से संविदात्मक है और इसके समाधान के लिए समझौते में मध्यस्थता का स्पष्ट प्रावधान है. ऐसी स्थिति में रिट याचिका के माध्यम से सीधे हस्तक्षेप उचित नहीं है।
