There is no basis to prosecute in-laws for cruelty by remaining mute spectators: Supreme Court

New Delhi: The Supreme Court has said that a woman’s in-laws cannot be prosecuted for cruelty or demand for dowry merely because they remained mute spectators to disputes between husband and wife and did not come to the daughter-in-law’s rescue. It states that although such conduct is questionable on ethical grounds, it does not automatically lead to criminal culpability. The bench of Justices Sanjay Karol and NK Singh said that the criminal law cannot be applied against each member of the husband’s family merely on the basis of generalized and omnipresent allegations and in the absence of specific acts attributable to any person/persons.“The mere allegation that the family members ‘supported’ the husband, failed to intervene or advise the complainant to make adjustments in the marital relationship, without any further consideration, will not in fact attract criminal liability. Indeed there may be situations where some relatives remain passive spectators or fail to come to the aid of the complainant; Such conduct, though morally questionable, cannot automatically be raised to the status of criminal culpability unless the surrounding circumstances clearly disclose his active involvement or participation in the alleged offences,” the bench said. The court quashed criminal proceedings against her in-laws in a case where a woman in Guna, Madhya Pradesh, had accused her husband and in-laws of dowry harassment, noting that no specific allegations were made against them. Even as it said that the suffering of a woman in a failed marriage cannot be ignored lightly, it appealed to the courts to exercise more caution while dealing with matrimonial dispute cases and investigate the allegations carefully. It noted that marital disputes are often accompanied by heightened emotions, strained relationships, and deep personal grievances. Given the circumstances, complaints alleging cruelty and harassment often involve not only the spouse but also his or her entire family, including relatives who have little or no active role in the marital dispute. What is important in this context is whether there are specific allegations revealing active participation on the part of such persons in acts such as cruelty, harassment or unlawful demand of dowry.

Every migrant should not be tortured in his own country: Trump tightens asylum rules, asks ICE to stop fraud

Every migrant should not be tortured in his own country: Trump tightens asylum rules, asks ICE to stop fraud
The Trump administration issued a new memo asking ICE to investigate asylum fraud.

Hundreds of migrants enter the US and then claim asylum, citing torture in their home country. They become lawyers and the case goes to immigration court as these immigrants are also trained on how to lie about their past and how to gain protection in the US. The Donald Trump administration will now put a stop to this large-scale fraud. But who will investigate this fraud? US Immigration and Customs Enforcement, which has its own lawyers, has been asked to crack down on fraudulent asylum claims, as it is unlikely that every migrant is being persecuted in their home country.DHS General Counsel James Percival said, “For years, millions of illegal aliens have defrauded our immigration system. Nowhere is this more so than in immigration court.” “Protection claims such as asylum are intended to cover unique and narrow circumstances, but it is standard practice for immigration lawyers representing illegal aliens to claim that virtually every illegal alien will be persecuted or tortured in his or her home country. Historically, ICE has relied on discipline from immigration judges and enforcement of criminal fraud laws to deter this conduct, but ICE has its own tools. Now, thanks to this directive, ICE lawyers have more authority to enforce the law and prevent abuse of our asylum system by illegal aliens and lawyers. In March 2025, President Trump issued a memo stating that “the immigration bar, and powerful Big Law pro bono practices, often train clients to conceal their past or lie about their circumstances while asserting their asylum claims, all in an effort to circumvent immigration policies put in place to protect our national security and to deceive immigration authorities and courts into granting them unwanted relief.”The memo said any efforts “must include enforcement against immigration attorneys who file false asylum claims in immigration court.”According to federal law, any non-citizen who is physically present in the United States or arrives in the country outside a designated port of entry and regardless of status may apply for asylum. But to be accepted, individuals must prove that they are eligible – usually by showing a reasonable fear of persecution on the basis of race, religion, nationality, political opinion or membership in a particular social group.

EB-2 green card cap for India ends by 2026: What does it mean?

EB-2 green card cap for India ends by 2026: What does it mean?
The EB-2 green card quota for India has ended for 2026.

The US State Department has announced that it has released all available immigrant visas in the employment-based second preference (EB-2) category for India in 2026. EB-2 is a green card Category for professionals with advanced degrees or people with extraordinary abilities. The annual limit will be reset on October 1, 2026, at the start of the new fiscal year. The department said embassies and consulates cannot issue EB-2 green cards for Indians until 2026.

What is EB-2? What does it mean when the quota is exhausted?

The Immigration and Nationality Act (INA) limits the number of employment-based preference immigrant visas that can be issued within a fiscal year. Specifically, INA 203(b)(2) provides that the annual limit for EB-2 visas is 28.6 percent of the worldwide employment limit. Additionally, INA 202(a)(2) establishes that natives of any one foreign state may not receive more than seven percent of the total employment-based and family-sponsored visas, which is prorated among the different visa categories under INA 202(e).Calculating the per country limit of 7%, India receives approximately 2800 EB-2 green cards per year. The total number of employment-based green cards is 140,000 and EB-2s get 40,000 – about 28.6%.According to the latest Visa Bulletin, the EB-2 final action date is September 1, 2013, which means that people who applied for a green card on that day are now eligible for a green card. But since the quota has already been exhausted, there will be no further movement. However, USCIS may continue to accept adjustment of status filings for cases who are now eligible to receive an EB-2 green card. Interviews may be postponed and even if interviews take place, cases will not be approved until the visa number is available. The department said in its final bulletin that it had to push back the final action dates due to high demand for the EB-1 and EB-2 visa categories. “If India’s proportionate limits in the EB-1 or EB-2 categories are reached before the end of the fiscal year, further regressions, or making the categories “unavailable,” may be necessary in the coming months,” the visa bulletin said. Now, the EB-2 category is marked as unavailable.

Morgpy Twitch ban: Morgpy temporarily banned from Twitch after controversial “Dark Souls” livestream

controversial

Morgpi has once again found himself in trouble with Twitch, after one of his latest livestreams was temporarily suspended. The streamer, already known for testing Twitch’s content rules, recently streamed himself playing Dark Souls III in a very unusual way. Instead of showing the game on a screen normally, he used a green-screen effect to project the gameplay beneath his bare feet. The stream quickly went viral online and she was jokingly called “Dark Souls”, combining the game’s name with the soles of her feet. Many viewers found the idea ridiculous, while others believed it crossed the line of what should be allowed on Twitch. Shortly after the broadcast, Morgpi revealed on X that his Twitch channel was temporarily suspended. She later told followers that “deep soles” The streams will continue once his account is back.

Morgpi’s “Dark Souls” ft. stream sparks another Twitch controversy

This isn’t the first time Morgpai has stirred debate on Twitch with creative green-screen content. In the past, she became one of the most talked about streamers during Twitch “Nudity Meta,” Where the creators used camera angles and other tricks to create a near-nude appearance without breaking the rules of the stage. Due to such streams, Twitch later updated its guidelines to prevent creators from focusing on certain body parts in a sexual manner.Morgpy also previously streamed gameplay projected onto his buttocks, which reportedly led to Twitch adding new rules banning its use “intimate” Body parts as green screen. However, Twitch’s current policy specifically mentions body parts such as breasts, waist, and buttocks, while legs are not directly included in the rules. Because of that, some viewers are now confused as to why the latest stream was suspended. At the moment, Twitch has not publicly stated the exact reason behind the ban. Nevertheless, many online users believe the platform may have considered the stream as containing suggestive content under its broader sexual content policies. Despite the suspension, Morgpi looks set to continue “deep soles” series once his Twitch channel is restored.
