But for home buyers, the experience can be stressful when builders delay possession, fail to deliver promised amenities, or stop responding to queries altogether.<span class=When such disputes arise, the Real Estate Regulatory Authority (RERA) acts as the primary forum for grievance redressal. It allows an aggrieved person to file a complaint against the promoter, allottee or real estate agent for alleged violation of the Act, rules or regulations; Such as delay in possession, poor construction quality, misleading advertising, breach of contract, or non-registration of a project.Section 31 of the Act provides for filing of a complaint by the aggrieved person with the regulatory authority or the adjudicating officer, as the case may be. The form, manner of filing the complaint and the fee payable should be specified by rules to be made by the appropriate Government.

step by step process

Although the process for filing a complaint varies from state to state, the following steps apply to most of them. Identify the correct state portal based on where the property is located. You can also find the link to your state’s RERA portal using the main RERA website.

  1. Register on the portal with your email and create a login ID and password.
  2. Go to the complaint section and fill in the details which include- complainant information, project RERA number, property information, respondent details and clear description of the complaint and relief sought.
  3. Pay the specified complaint fee and submit your application. It is important to note the complaint reference number for tracking.
  4. Track the status online through the same portal.

Form M and Form N

Form M is filed directly with the RERA authority and is used when a home buyer wants to report violations by a promoter or real estate agent. On the other hand, Form N is used to file a complaint in any case related to compensation where a real estate promoter or real estate agent is at fault before the adjudicating officer.

State wise difference in process

Some states require the complainant to submit a hard copy of the complaint to their respective RERA office. For example, in Assam the complainant is required to submit a copy of the set containing the complaint in Form “M”, Registration Form (Proforma B) and enclosures of fees paid and demand draft and detailed typed complaint and self-declared and signed certificate.Kerala RERA does not have a provision for filing complaints online. The complainant has to submit the complaint to the Authority by registered post or directly in person at the office of the Authority with sufficient number of necessary copies to be sent to the respondents along with supporting documents.The authority usually takes action on the complaint and provides further instructions through the portal or other communication methods. This may include notices, schedules for hearings, requests for production of documents or updates regarding the status of the complaint.If a hearing is arranged, the complainant should prepare the relevant facts, supporting documents and the specific relief sought. This process continues through a hearing until a decision is reached. The judgment may mandate compliance, issue refunds, require corrections, or offer some other type of relief, depending on the circumstances of the case.
