New Delhi: The Bar Council of India (BCI) and the Supreme Court Bar Association (SCBA) on Wednesday urged CJI Surya Kant to immediately intervene after an Andhra Pradesh High Court judge decided to send a young lawyer to 24-hour judicial custody in an alleged rape case despite repeated pleas for mercy.BCI president Manan Kumar Mishra wrote to the CJI: “Incidents of this nature have a bad impact on the young members of the Bar. They create fear in their minds. The dignity of the court does not increase when a lawyer has to beg for favors in open court and yet is sent to custody for procedural lapses.”Based on a video of the incident at the HC on social media, the SCBA passed a resolution on Wednesday under the leadership of its president Vikas Singh.“Any action that causes fear, humiliation or intimidation among young advocates has the potential to adversely impact the independence of the Bar and the optimal functioning of the justice delivery system,” reads the SCBA resolution.The SCBA requested the CJI to call for relevant records from the HC and take corrective measures on the administrative side in the interest of maintaining public confidence in the judiciary and maintaining cordial bar-bench relations. BCI’s Mishra also made a similar request.
