SC: Law is against commercialization of prostitution, does not want to ban it

New Delhi: After a “detailed and nuanced” analysis of the 70-year-old Immoral Traffic Prevention Act (ITPA), the Supreme Court has ruled that the main objective of the law is neither to eliminate prostitution nor to make it a criminal offence, but to prevent its commercialization.A bench of Justices JB Pardiwala and R Mahadevan said, “We are convinced that the main objective of the Act is not to eliminate prostitution or to make prostitution a criminal offence. Rather, its objective is to prevent or eliminate commercialization of prostitution, that is, prostitution as an organized means of earning a living.”While dealing with the issue of rehabilitation of women rescued from brothels, the bench analyzed the 1956 Act and said that in the early 20th century, trafficking of women for prostitution was common and considered “immoral”, hence the term got attached to the law.The Immoral Traffic Prevention Act (ITPA) was brought in primarily to punish criminals and not to punish prostitutes,” the Supreme Court said.Writing the 298-page judgment, Justice Pardiwala said Sections 7 and 8 of the Act, which provide for punishing individual acts of prostitution in specific circumstances such as “open prostitution”, are exceptions to this general rule. Section 7 punishes any person engaged in prostitution near public places, and Section 8 criminalizes soliciting clients in public places. The bench said, “The view is that although individual acts of prostitution do not directly demand abandonment, yet public decency and social morality require that even visible initiatives for such solitary, non-commercial forms of prostitution in the vicinity of public institutions and other notified areas be prevented in order to prevent public nuisance.” Wasn’t trying to make a case for de-regulation. Business. What we are trying to convey is that while making it clear that the legislative intent is not to condemn all acts of prostitution, the definition retains some regulatory ambiguity by characterizing it solely as abusive or exploitative. On examination of the definition of the word ‘brothel’ in Section 2 of the Act, the bench said, “It must be made clear that where a single woman carries on prostitution for her livelihood, without any other prostitute, or without involving any other person in the maintenance of such premises, her residence will not be a ‘brothel’.”

BJP team meeting at PM residence to finalize RS, MLC elections. india news

New Delhi: Ahead of the elections for 24 Rajya Sabha seats and MLC in some states, BJP’s Central Election Committee (CEC) held a meeting at PM Narendra Modi’s residence on Sunday to finalize the names of candidates. The CEC includes Union ministers Amit Shah and Rajnath Singh and BJP president Nitin Nabin, and its meeting took place a day before the filing of nominations for the Rajya Sabha elections. Soon after the meeting, the BJP released its list of 10 candidates for the MLC elections on 16 seats in Maharashtra, a day before the deadline for filing nominations. It is rare for BJP CEC members to hold a physical meeting ahead of the RS or MLC elections, and there is a view that top party functionaries may also have deliberated on other important political matters, including the impending change in the national team of office-bearers of the organisation. The dispute between top officials of the state BJP and its two Maharashtra allies, Shiv Sena and NCP, over their share of MLC seats may also have prompted the BJP top officials to intervene. As the standoff continued, Army chief and deputy CM Eknath Shinde had raised the matter with Shah. The 24 Rajya Sabha seats are spread across Andhra Pradesh (4), Gujarat (4), Karnataka (4), Madhya Pradesh (3), Rajasthan (3), Jharkhand (2), and one seat each is vacant in the four northeastern states of Arunachal Pradesh, Manipur, Meghalaya and Mizoram.

Go back to the people, find out how reforms have helped: PM Modi to ministers | india news

New Delhi: Amid the government’s big push on next-generation reforms to ease life and ease of doing business, PM Modi has directed all ministries and departments to reach out to the target beneficiaries – citizens and businesses – to assess the impact of policy amendments on their lives and work.TOI has learned that PM Modi, while chairing the last Council of Ministers, had told his cabinet colleagues and top bureaucrats not to limit themselves to merely introducing and notifying reforms. Cabinet Secretary TV Somanathan and secretaries of more than half a dozen departments made presentations on reforms undertaken by ministries and departments in the last two years.“The message was to see whether the reforms have brought about the desired results, and the impact can be assessed only after receiving feedback from the desired group. “Reforms should focus on people and take into account every aspect and not just be treated as an administrative exercise,” said an official who attended the meeting.Officials said ministries and departments have been asked to consider all the issues in depth and identify further areas for improvement during consultations with stakeholders. “Most of the major reforms have been implemented. The focus now should be on fine-tuning the nuts and bolts of process reforms. This should be driven by each ministry and department concerned,” said a person with knowledge of the deliberations. An official said the ministries now intend to interact with stakeholders to assess the impact of the steps taken by them over the past few years and also identify new measures that may be required. It is also learned that the departments have been asked to focus on resolution of public complaints, including designating officers to deal with citizens’ complaints. Noting that the government remains the largest litigant, the Prime Minister has also directed officials to take measures to reduce court cases and arbitration. “This is a directive to ensure that no new cases arise in the future due to any regulatory framework,” said an official. “Each agency should ensure that the affidavits are filed on time and are of good quality.”

Due to emphasis on electrification of railways, diesel consumption reduced by 63%. india news

Diesel consumption reduced by 63% due to electrification campaign of Railways

New Delhi: Indian Railways’ push to electrify its network has reduced its diesel consumption by 185 crore liters annually, equivalent to about four days of India’s total diesel demand. With electrification of the railways’ broad-gauge network reaching 99.6%, the volume of diesel usage has fallen by about 37% compared to 2016-17, officials said.“As against 293 crore liters of diesel consumption in 2015-16 – the first year after electrification was taken up in mission mode – the consumption is 108 crore liters in 2024-25. This has further reduced. Electrification of the railway network has saved us from the fuel issue that the entire world is grappling with,” an official said. He said that more attention has also been given to obtaining power from renewable sources for railway operations. The official said electrification has saved foreign exchange for the exchequer, which would otherwise have been required to import fuel.Official data shows that only 21,801 route km of Indian Railways were electrified as of 2014, in the last 12 years, another 48,072 km have been electrified.Logistics sector insiders said that if the Railways had not accelerated the electrification of its network, train operations for both passengers and freight would have been adversely impacted in a post-West Asia conflict scenario. A railway official said, “Line haulage costs, for both passengers and freight, using electric traction are much lower than diesel – about one-sixth in the case of passenger movement and about one-third in the case of freight movement.”The current focus on obtaining electricity from renewable sources will make railways an even cleaner mode of transport.
