फैजाबाद सेशन कोर्ट का फैसला रद्द
20 सितंबर 2010 को फैजाबाद जिले में पड़ोसी निर्मल कुमार पर नाबालिग लड़की से दुष्कर्म का आरोप लगा था. तीन दिन बाद पीड़िता की मौत हो गई. पीड़िता के पिता ने निर्मल कुमार के खिलाफ प्राथमिकी दर्ज करायी है. सेशन कोर्ट ने आरोपी को दोषी पाया और आजीवन कारावास की सजा सुनाई. इसके खिलाफ निर्मल कुमार ने हाई कोर्ट में अपील दायर की, जिसे अब स्वीकार कर लिया गया है.
कोर्ट ने जांच एजेंसी की गलतियों पर टिप्पणी की
कोर्ट ने अपनी टिप्पणी में कहा कि फोरेंसिक रिपोर्ट में पीड़िता के वेजाइनल स्वैब पर मानव वीर्य जरूर मिला, लेकिन यह साबित नहीं हुआ कि वह निर्मल कुमार का था. कोर्ट ने डीएनए टेस्ट या साइंटिफिक मैच न होने को जांच एजेंसी की गंभीर चूक बताया.
संदेह के आधार पर जेल में रखना गलत है
हाई कोर्ट ने कहा कि बिना ठोस और वैज्ञानिक सबूत के किसी व्यक्ति को 11 साल तक जेल में रखना उचित नहीं है. महज अनुमान और संदेह के आधार पर किसी को दोषी ठहराना कानूनन गलत है। इसके आधार पर खंडपीठ ने निर्मल कुमार को रिहा करने का आदेश दिया.
न्यायिक निर्णय का महत्व
यह निर्णय न्यायिक प्रक्रिया में ठोस साक्ष्य के महत्व को दर्शाता है। अदालत ने संदेश दिया कि कानून महज संदेह के आधार पर लोगों की जीवन भर की आजादी नहीं छीनेगा और जांच एजेंसियों की गलतियों को गंभीरता से लिया जाएगा।

It was alleged that the accused demanded undue favors of Rs 3 lakh from the complainant for reactivating the cashless medical facility for a private hospital in Manesar. In this the complainant had already paid one lakh rupees. Later the total amount was negotiated at Rs 2.6 lakh.

New Delhi: Chief Minister Rekha Gupta lauded the Central government for regularizing Delhi’s unauthorized colonies on an “as is, where is” basis under the PM-UDAY scheme, saying the new framework allows 1,531 colonies to be regularized without the need for layout plan approval. Further, he informed that all plots and buildings within these colonies will be considered residential. Addressing a press conference at the National Media Center on Tuesday, he further informed that the joint survey will be conducted by the revenue officials under strict timelines. DDA-GIS survey will be completed within 7 days, deficiencies resolved within 15 days and conveyance deed issued within 45 days. He also said that out of 1,731 unauthorized colonies, 511 were being regularized immediately. “…In 2019, the government launched the PM-UDAY scheme for unauthorized colonies in Delhi. Under it, ownership transfer and mortgage rights were provided to residents. So far, around 40,000 conveyance deeds and authorization slips have been issued, although technical problems slowed down the progress, especially with the approval of the layout plan. Thanks to the intervention of the Prime Minister and the Urban Ministry, a major step has now been taken. There are about 50 lakh residents in unauthorized colonies in Delhi, about 10 lakh families. The new scheme allows regularization of 1,531 colonies, without requiring layout plan approval. CM Gupta said, all plots and buildings will be considered residential. “The approval process has been simplified: the responsibility now rests with the Revenue Department of Delhi, with ADM level officers as the single-point approval authority. The survey will be conducted jointly by revenue officials and strict timelines have been set. The remaining excluded colonies are in restricted areas such as ridge areas, ozone-sensitive areas or near protected monuments. Authorization certificates will be issued by MCD…” CM Gupta said. Earlier, the central government had launched the Prime Minister-Unauthorized Colonies Housing Rights Scheme (PM-UDAY) in Delhi in 2019 to provide ownership rights to residents. However, progress under the Delhi Development Authority (DDA) remained slow for a long time. मार्च से अब तक देहरादून जिले के सरकारी अस्पतालों में लगभग 10 मरीज डेंगू पॉजिटिव पाए गए हैं। स्वास्थ्य विभाग ने एहतियात बरतते हुए डेंगू और मलेरिया को लेकर अस्पतालों को एडवाइजरी जारी की है.
इसके तहत अस्पतालों में आइसोलेशन वार्ड तैयार करने के निर्देश दिए गए हैं. साथ ही पॉजिटिव केस को अविलंब आईडीएसपी पोर्टल पर अपलोड करने का निर्देश दिया गया है. आमतौर पर डेंगू के मामले जुलाई के बाद ही सामने आते हैं, लेकिन मार्च-अप्रैल में डेंगू के मामले सामने आने पर स्वास्थ्य विभाग सतर्क हो गया है।
विभाग ने इस क्रम को तोड़ने की तैयारी शुरू कर दी है। हाल ही में मुख्य चिकित्सा अधिकारी ने जिले के सभी सरकारी और निजी अस्पतालों को एडवाइजरी जारी कर डेंगू और मलेरिया से लड़ने की तैयारी पूरी करने को कहा है. इसमें सभी अस्पतालों में आइसोलेशन वार्ड रखना अनिवार्य होगा. इन वार्डों के सभी बेडों पर मच्छरदानी लगानी होगी। इसके अलावा सभी जरूरी दवाएं भी रखने को कहा गया है.
एलाइजा टेस्ट में पॉजिटिव मरीजों को ही डेंगू पीड़ित माना जाए।
विभाग ने सभी अस्पतालों को सख्त निर्देश दिए हैं कि केवल एलाइजा पॉजिटिव मरीजों को ही डेंगू का मरीज माना जाए। कई बार अगर अस्पताल का कार्ड जांच में डेंगू पॉजिटिव पाया जाता है तो उसे डेंगू पॉजिटिव माना जाता है, लेकिन बाद में जब एलिसा से जांच की जाती है तो वह नेगेटिव आता है। डेंगू के लिए एलिसा सबसे विश्वसनीय परीक्षण है।
