New Delhi: In a move in line with New Delhi’s consistent position that Pakistan-occupied Jammu and Kashmir (PoJK) is an integral part of India, a provision has been included in the Delimitation Bill, 2026 Election Commission To delimit the Jammu and Kashmir constituencies which are currently occupied by Pakistan, whenever they “cease to be occupied”.The number of elected members of Jammu and Kashmir Assembly is 90; This does not include the 24 seats in PoJK that remain ‘vacant’ and are not taken into account in calculating the total membership of the Assembly. The Union Territory Laws (Amendment) Bill, 2026 authorizes the Delimitation Commission to decide on the revised strength of the Jammu and Kashmir Assembly, which will not be less than the existing 114 seats. It withdraws the provision of the Jammu and Kashmir Reorganization Act to exclude PoJK area and seats while delimiting the regional constituencies of Jammu and Kashmir.The Bill proposes to amend Section 15 of the Jammu and Kashmir Reorganization Act to increase the number of women nominated to the Jammu and Kashmir Assembly by the Lieutenant Governor from two to three. However, this will increase only after the readjustment of constituencies based on fresh delimitation comes into effect.According to the Statement of Objects and Reasons of the Bill, the provisions of the Union Territory Government Act, 1963, the Government of National Capital Territory of Delhi Act, 1991 and the Jammu and Kashmir Reorganization Act, 2019 are based on the existing constitutional framework relating to population, delimitation and reservation.
