The Allahabad High Court granted anticipatory bail to saint Swami Avimukteshwarananda Saraswati and his disciple Mukundananda Brahmachari in a case related to allegations of sexual exploitation of minors under the Protection of Children from Sexual Offenses (POCSO) Act.The relief was granted on Wednesday by Justice Jitendra Kumar Sinha, who directed both the complainant and the accused to refrain from making any public statements regarding the case.The court allowed the anticipatory bail plea, stressing that the investigation should proceed without any outside influence. Along with granting protection from arrest, the court also imposed restrictions on both the parties and barred them from speaking to the media on the matter.The order comes weeks after the court reserved its verdict after a detailed hearing and granted interim protection from arrest to the first accused.

On February 27, the High Court had stayed the arrest of Avimukteshwaranand and directed that he will not be detained until the final order is pronounced. During the proceedings, the court had directed both the state government and the complainant to file their reply and asked the accused to cooperate fully in the investigation.
Charges and FIR details
The case pertains to an FIR lodged at Jhunsi police station in Prayagraj, following directions from the POCSO court. The complaint has accused several ‘batukas’ (young disciples) associated with the ashram of sexual exploitation.The complainant, Ashutosh Pandey alias Ashutosh Brahmachari, has claimed that the minors were abused, expressing hope that “justice will be served once the evidence is presented in the court.”
Defense and prosecution arguments
The defense has strongly denied the allegations, calling them fabricated. It argued that the complainant has a criminal background and claimed that the alleged victim had never stayed in the saint’s ashram. The watcher also questioned the authenticity of the medical report and accused the complainant of trying to influence the case.In a notable submission, Avimukteshwarananda expressed his willingness to undergo narcoanalysis test to prove his innocence.However, the state opposed the anticipatory bail plea on procedural grounds, arguing that the accused had first approached the High Court instead of approaching the sessions court.
